What Are the Consequences for Multiple DUIs in Maryland?

Posted on August 06, 2026 in DUI Defense

Multiple DUI convictions in Maryland can lead to mandatory jail time, higher fines, license suspension, and ignition interlock requirements. The penalties become more serious with each conviction, especially if the offenses happen within five years of each other.

Posner & Cord, LLC represents people facing Maryland DUI and DWI charges. Our Timonium DUI lawyer can explain your options and fight for the best possible outcome.

What Happens After a Second DUI in Maryland?

Maryland has separate charges for driving under the influence (DUI) and driving while impaired (DWI). DUI is the more serious offense.

Under Maryland Transportation Article Section 21-902, a second DUI conviction can result in up to two years in jail and a fine of up to $2,400.

If your second DUI happens within five years of your first, Maryland law requires at least five consecutive days in jail. A judge cannot waive that mandatory sentence.

The court may also order alcohol treatment, probation, and other conditions based on the facts of your case.

What Happens After a Third DUI in Maryland?

The penalties increase after two prior impaired driving convictions. A third DUI can result in up to five years in jail and a fine of up to $5,000.

If you have three or more prior impaired driving convictions, another DUI can carry up to 10 years in jail and a fine of up to $10,000. Maryland still classifies these offenses as misdemeanors.

A third DUI within five years of a prior DUI also carries a mandatory minimum sentence of 10 consecutive days in jail.

Can Multiple DUIs in Maryland Cause You to Lose Your License?

In addition to criminal penalties, you may face action from the Maryland Motor Vehicle Administration.

A DUI conviction adds 12 points to your Maryland driving record. That is enough for the MVA to revoke your license.

The MVA considers you a repeat offender if you receive two or more DUI convictions within five years. Repeat offenders may face a one-year license suspension followed by one year of driving only vehicles equipped with an ignition interlock device.

Some drivers may qualify for the Maryland Ignition Interlock Program instead of serving the suspension. An ignition interlock requires a clean breath sample before your vehicle will start and may require additional breath tests while you are driving.

These restrictions can make it harder to get to work, school, medical appointments, and other daily activities. If you fail a test or violate the program's rules, you may have to stay in the program longer.

What Can Make Repeat DUI Penalties Worse in Maryland?

Some facts can lead to even tougher penalties, including:

  • Having a child in the vehicle
  • A blood alcohol concentration of 0.15 percent or higher
  • Refusing a breath or blood test
  • Causing a crash, injuries, or property damage
  • Reckless driving
  • Driving on a suspended or revoked license
  • Violating probation from an earlier DUI

For example, a second DUI involving a minor passenger can result in up to three years in jail and a fine of up to $3,000.

Can You Fight a Repeat DUI Charge in Timonium?

A prior conviction does not mean you will automatically be convicted again. The prosecution still has to prove the new charge beyond a reasonable doubt.

Your lawyer can review whether the traffic stop was legal, whether field sobriety tests were reliable, and whether breath or blood testing was handled correctly. In some cases, the evidence can be challenged, or the charges may be reduced.
